Canada updated Instructions for the Spouse or Common-Law Partner in Canada Class

Instructions for the Spouse or Common-Law Partner in Canada Class Updated

On June 8, 2022, the Government of Canada updated instructions regarding determining membership in the spouse or common-law partner in the Canada class. The revised instructions for circumstances when there is a relationship breakdown and the primary applicant (sponsored spouse) wishes to proceed with their permanent residence application.  The conversion to humanitarian and compassionate grounds is applicable for these cases. In addition, the instructions have been updated to include further clarification on these cases under the exemption from the requirement to have temporary resident status. The foreign national meets the membership requirements of the spouse or common-law partner in the Canadian class if all of the following apply if they: are the spouse or common-law partner of a sponsor (as defined in R130) and cohabit with that sponsor in Canada (Common-law partners must have cohabited for at least one year) have temporary resident status  are the subject of a sponsorship application if they are not excluded from the class under R125 concerning excluded relationships   Lawful temporary resident status in Canada To become members of the class for eligibility, applicants in the spouse or common-law partner in Canada class must have valid temporary resident status on the date of application and on the date they receive permanent resident status. Exemption from requirement to have temporary resident status The spousal public policy facilitates the processing of genuine out-of-status spouses or common-law partners in the spouse or common-law partner in the Canada class who meet the other eligibility requirements of the class. Applicants who are covered under the public policy should be processed according to the provisions of the spousal public policy. Applicants who do not have temporary resident status and who are not eligible under the spousal public policy can be removed at any time. Further, the spousal policy does not change the requirement to seek necessary authorization to visit Canada or to work or study here. If the applicant cannot be exempted from the legal temporary resident status requirement under the spousal public policy they may request an exemption from the requirement to have temporary resident status in Canada on Humanitarian and compassionate grounds. See Humanitarian and Compassionate considerations for applicants in the spouse or common-law partner in Canada class. Public policy cases where the relationship is ongoing but the applicant has been deported or where the applicant and sponsor are in an excluded relationship (for example, R4, R5, R125 (1) (d)) should not result in the application being converted to a humanitarian and compassionate in-Canada application. Instead, these humanitarian and compassionate grounds requests should be considered in the context of the spouse or common-law partner in Canada class.   Temporary resident requirement in Canada Other requirements applicable to a foreign national, who apply to remain in Canada as a member of the Spouse or Common-law Partner in Canada Class: a foreign national is not considered a spouse or common-law partner if the marriage or common-law partnership is not genuine or was entered into primarily for the purpose of acquiring any status or privilege under the Act [R4] a foreign national is not considered a spouse or common-law partner if a new conjugal relationship was begun after a previous marriage or common-law partnership with that person was dissolved primarily to acquire any status or privilege under IRPA [R4.1] a foreign national must not be the subject of enforcement proceedings or a removal order for reasons other than “lack of status” (see definition of “lack of status” under the spousal public policy). Although most persons who are under a removal order or facing enforcement proceedings for reasons other than “lack of status” are eligible for initial consideration under the public policy as they meet the criteria in R124, they cannot be granted permanent residence as they will be found inadmissible in the second stage of processing a foreign national becomes a permanent resident if they meet the requirements of R72 a foreign national and their family members must meet admissibility requirements (R72), however, they are exempt from inadmissibility on health grounds due to excessive demand on health and social services a foreign national must have a valid passport or travel document by the time permanent residence is granted (R72) Noted: “Lack of status” may also refer to persons who have overstayed a temporary resident permit. IRCC Express Entry Draw

IRCC Held the First IRCC Express Entry Draw Targeting Francophone Candidates in 2025

On February 19, 2025, Immigration, Refugees and Citizenship Canada (IRCC) held its first IRCC Express Entry draw of the year for French-speaking candidates. This special category-based draw is a testament to Canada’s efforts to enhance its bilingual workforce and recruit skilled Francophone immigrants outside Quebec. In round #337, 6,500 Invitations to Apply (ITAs) were issued to qualified Francophone candidates, a major opportunity for French-speaking professionals looking to settle in Canada. Lower CRS Score Boosts Opportunities for Francophone Candidates One of the most remarkable aspects of this IRCC Express Entry Draw was the Comprehensive Ranking System (CRS) cut-off score of 428, which is 38 points lower than the previous Francophone-focused draw held on December 3, 2024. This significant decrease in CRS cut-off enhances accessibility for a broader range of candidates, making it easier for skilled French-speaking individuals to qualify for permanent residency in Canada. The tie-breaking rule for this round was set on February 10, 2025, at 16:41:38 UTC, meaning candidates who had a CRS score of 428 or higher and submitted their Express Entry profiles before this date received an ITA. Check Your Eligibility IRCC Express Entry Draw: Pool Insights As of February 16, 2025, there were 234,644 active profiles in the IRCC Express Entry Draw pool, highlighting the high level of competition among candidates. Despite this, the targeted nature of the Francophone draw gives French-speaking candidates an advantage, reinforcing Canada’s efforts to promote linguistic diversity and meet labor market needs in different provinces and territories. Canada’s Commitment to Francophone Immigration Canada has long recognized the importance of French-speaking immigrants in contributing to economic growth and cultural diversity. To encourage Francophone immigration outside Quebec, IRCC Express Entry Draw has been conducting category-based draws, allowing French-speaking candidates to have a competitive edge even if their CRS scores are lower compared to general draws. By introducing these programs, the government wants to achieve its Francophone immigration goals and build French-speaking populations throughout Canada. With immigration rules constantly changing, French-speaking specialists can anticipate further opportunities via Express Entry in the months ahead. Why Francophone Candidates Should Take Advantage of This Opportunity? With the lower CRS requirement and a high number of ITAs issued, now is an ideal time for French-speaking professionals to enter the Express Entry pool. This draw signals Canada’s ongoing commitment to prioritizing Francophone immigration, offering greater chances of success for eligible candidates. Additionally, skilled workers with French language proficiency have access to various benefits, including: Higher CRS points for French proficiency under Express Entry. French language proficiency Express Entry French language proficiency plays a crucial role in Canada’s Express Entry system, particularly for candidates applying under the Federal Skilled Worker Program (FSWP) and Canadian Experience Class (CEC). The Immigration, Refugees and Citizenship Canada (IRCC) Express Entry Draw awards additional Comprehensive Ranking System (CRS) points to candidates with strong French language skills, even if French is their second language. As of recent updates, candidates who achieve NCLC 7 or higher in all four language abilities (reading, writing, speaking, and listening) can earn up to 50 additional CRS points.  This provides a significant advantage in receiving an Invitation to Apply (ITA) for permanent residency. In some cases, provinces like Quebec and Ontario also have separate immigration streams that prioritize French-speaking candidates. Strengthening French proficiency can enhance a candidate’s chances of securing permanent residence in Canada. Express Entry French-Speaking Skilled Worker Stream The Express Entry French-Speaking Skilled Worker Stream is a specialized pathway to attract French-speaking immigrants to Canada. This stream operates under the Ontario Immigrant Nominee Program (OINP) and targets candidates with strong French language proficiency and English skills. Eligible applicants must have an active Express Entry profile and meet Ontario’s provincial selection criteria.  Those nominated receive an additional 600 Comprehensive Ranking System (CRS) points, significantly increasing their chances of receiving an Invitation to Apply (ITA) in an IRCC Express Entry Draw. Canada to face Increasing Job Vacancies

Canada to face Increasing Job Vacancies on June 24, 2022, Statistics Canada published a new report reflecting the Canadian labor market. According to the study, employers in Canada were actively looking to fill roughly 1 million job openings at the beginning of April, which is up 2.4 percent from the previous months and almost 45% from April. According to Statistics Canada, the rise in April was largely due to seasonal factors, with more employment becoming vacant in the spring and summer. The report also reveals that employment in all provinces has either recovered or exceeded the preceding numbers since the COVID-19 pandemic. Because the economy started to reopen after the third Canadian wave of COVID-19, economists had hoped that momentum might continue into July. But the job gains came in far lower than the 165,000 that was expected.   The analysis report also showed that job vacancies are continuing on a high-placed trend in the manufacturing and retail trade sectors. These Vacancies in manufacturing peaked at 87,400 last quarter, and retail trade employers’ vacancies were as high as 114,600.    Check your eligibility for Immigration to Canada   Statistics Canada documented Friday that almost all of the new jobs came in Ontario, which added 72,000 jobs. Nova Scotia, Manitoba, and Prince Edward Island also added jobs, while everywhere else, job levels were either unchanged or down. The number of vacancies was also at a record high for scientific, professional, and technical services; transportation and warehousing; finance and insurance; arts, entertainment, real estate, rental, leasing, and recreation.   The social assistance sector and health care saw the number of job vacancies fall to 125,200 in April from a peak of 147,500 in March, nevertheless, they were still up 21.3 percent compared with a year earlier.   Do you need help to Immigrate to Canada?
