On September 25, 2023, the Government of Canada published the Express Entry Year-End Report 2022. This report provides a comprehensive overview of the Express Entry, which was launched in January 2015, and is Canada’s flagship application management system for three federal high-skilled permanent economic immigration programs: the Federal Skilled Worker Program (FSWP) the Federal Skilled Trades Program (FSTP) the Canadian experience class (CEC) It also manages a portion of the Provincial Nominee Program (PNP). Express Entry is an effective tool for bringing in workers with the skills and training required to meet Canada’s growing economic needs and address labor market shortages. Express Entry Year-End Report 2022 As the Government published the Express Entry Year-End Report for 2022, there were:  428,391 Express Entry profiles were submitted, a 3% decrease from 2021 but a 19% increase from 2020.  At least 74% of the profiles were eligible for one of the immigration programs managed by Express Entry, with no change from 2021.  Men submitted more profiles (238,382) than women (189,881), with the proportion unchanged at 56% and 44%, respectively.  The ratio of eligible profiles remained the same for men (71%) from 2020 to 2022, but there was a slight increase for women in 2022 (78%). Express Entry Draws overview Changes to Express Entry in 2022 IRCC adopted the new National Occupational Classification (NOC) 2021 system, created by Employment and Social Development Canada and Statistics Canada, on November 16, 2022. The NOC is used by the IRCC to develop and assess occupational eligibility criteria for various immigration programs. NOC 2021 made structural adjustments by replacing skill-level groups with categories for Training, Education, Experience, and Responsibility (TEER). With the implementation of the NOC 2021, 16 new jobs were eligible under the FSWP and CEC, as well as eight new occupations under the FSTP.  Under the FSWP and CEC, 16 new occupations were eligible, while the FSTP added 8 new occupations. Among these are, but are not limited to, a number of in-demand jobs such as transport truck drivers bus drivers teaching assistants several occupations in the health field About the Comprehensive Ranking System Most Express Entry profile submissions in 2022 were made by people with CRS scores between 301 and 500. The CRS serves as a basis for the EE application management system. A CRS score is made up of two parts: core points and bonus points. These criteria help in assessing an applicant’s probability of success in the Canadian employment market. A candidate’s maximum CRS score is 1,200 points – 600 points for the core component and 600 points for the bonus points component. All information submitted at the profile submission stage to generate a CRS score is self-reported and must be backed with sufficient proof from the candidate at the application stage, or the application may be declined. The person’s human capital attributes (e.g., age, education, official language proficiency, work experience) are assessed under the core points. Overview of the ITAs issued by language proficiency in 2022 In general, those with stronger first official language proficiency received more ITAs in 2022, according to their Canadian Language Benchmark (CLB)/Niveaux de compétence linguistique canadien (NCLC) score. On October 4, 2023, the Government of British Columbia held new invitation draws under the BC PNP Draw of October and invited qualified Skills Immigration candidates.  In the general draw, BC invited 110 candidates. The minimum score for candidates invited to this draw was 91-113 points.  The province issued 51 ITAs to candidates under the childcare-targeted draw for early childhood educators (NOC 42202).  In the Healthcare-targeted draw, BC invited 25 candidates who scored 60 points.  In addition, fewer than five invitations have been issued for other priority occupations (NOCs 31103, 32104) As a candidate, you can work with an immigration specialist. Last week, Canada’s immigration department made significant changes to improve the operations of Immigration, Refugees and Citizenship Canada (IRCC) based on a commissioned study.  The changes were influenced by a report from Neil Yeates, a former Deputy Minister of IRCC, who evaluated the department’s structure and effectiveness. The department’s Deputy Minister, Christiane Fox, communicates with the Immigration Minister, Marc Miller, to implement the government’s elected mandate.  The department aims to be more responsive to global changes and humanitarian crises and incorporate applicants’ experiences in its decision-making process. After receiving the Yeates report and working with public stakeholders, such as IRCC applicants, Fox had a plan of action by June 2023. Since then, she has implemented the changes gradually. Why are there still increasing numbers of asylum claims in Canada? In March, Roxham Road, a pathway used by many asylum seekers to enter Canada, had been closed. However, Canada has still processed over 80,000 asylum applications this year.  This is partly due to expedited visa processing and more straightforward asylum claims at airports in Montreal and Toronto. Immigration offices in Ontario and Quebec also receive inland claimants who entered Canada legally or illegally.  Part of the answer, it appears, is that Montreal and Toronto’s international airports have become magnets for asylum seekers. According to Radio-Canada, immigration officials secretly implemented a new policy to speed temporary visa processing, including eliminating the requirement for applicants to provide proof that they will leave Canada at the end of their stay. This is said to have made it simpler for persons who would typically struggle to get tourist visas to enter and then claim asylum upon arrival. This is in contrast to decades of policy characterized by strict visa requirements and airline penalties for passengers boarding with fake documents. Recently released statistics also show that immigration offices in Ontario and Quebec are receiving a large number of inland claimants: migrants who entered Canada legally or illegally and then applied for asylum; this was already happening when Roxham Road was open; in 2022, Canada received another 50,000 asylum claims from migrants who were already in the country; and the situation is similar so far this year. Asylum seekers come to Canada for its generous treatment and benefits. Still, the top source countries for migrants needing protection are Mexico and India, which are not in political upheaval or armed conflict. What are the benefits of asylum claims in Canada? Asylum seekers want to come to Canada because it is a wealthy country with unrivaled treatment, including generous benefits and almost-guaranteed citizenship for those granted protection; in many other regions, they frequently receive inadequate food and shelter and exist precariously at the mercy of host governments. However, the influx of claims in Canada is not always tied to worldwide patterns. Despite the fact that Syria, Ukraine, and Afghanistan are the leading source countries for migrants seeking international protection, Canada’s Immigration and Refugee Board says that Mexico is our top source this year, with India ranking fifth. Manitoba invited new Ukrainian candidates under the MPNP

On September 29, 2023, the Government of Manitoba held the 18th draw for Ukrainian candidates. The province invited 42 candidates through the Manitoba Provincial Nominee Program (MPNP) in this draw.  To be eligible, applicants must be:  Ukrainian citizens,  have a minimum of CLB 4 in each language band,  have connections to the province (close relatives, community ties, previous employment, or studies in Manitoba), and  score at least 60 points in the EOI registration points grid, and  possess a valid language test in one of the official languages.  In total, the province invited 11,831 candidates in 2023, including 259 Ukrainian nationals. Manitoba PNP Invitation latest draws updates Manitoba to create an advisory council to develop an economic immigration strategy Manitoba is developing a plan to increase economic immigration through its new Advisory Council on Economic Immigration and Settlement (ACEIS). The province is focused on addressing labor shortages, encouraging economic development, and supporting its francophone population.  Strategy of the Manitoba Advisory Council The Council recommended a strategy to attract more immigrants and business investors, streamline the Manitoba Provincial Nominee Program, and improve newcomer retention. McGill and Concordia Universities will continue to attract anglophone international students

Quebec’s immigration minister believes that new rules requiring more French proficiency from international students will not negatively impact universities like McGill and Concordia. Previously, under the Quebec Experience Program (PEQ), international students could easily enter Quebec by combining education with career goals.  However, in 2019, eligibility limits were imposed, causing a backlash and a reversal of the decision. McGill University and Concordia University criticized the new rules, stating that they will attract international students despite the changes in the PEQ rules.  The PEQ, a popular program for international students, changed in May to increase the French language proficiency of applicants. However, the reforms will exclude graduates from anglophone universities, even if they are fluent in French. About the Quebec Experience Program (PEQ) The province of Quebec runs a number of immigration programs, one of which is the Quebec Experience Program (program de l’expérience québécoise, or PEQ). Candidates who speak French well and have lawfully obtained work experience in Quebec should apply to PEQ. PEQ is one of Quebec’s priority immigration programs, therefore applications are handled significantly more quickly than they would be in other programs like Quebec Skilled Worker (QSW). Ottawa urged to crack down on immigration employment scam

The Federal Government works to prevent employers from immigration employment scams and from charging fees to temporary foreign workers under the Temporary Foreign Worker Program (TFWP). However, some workers are still being exploited and made to pay large sums to secure jobs in Canada.  Immigrants pay to get a Canadian employer to apply for a Labour Market Impact Assessment (LMIA), which is needed for a work permit. Scams involving LMIA fraud are known, but the Government has taken steps to guard employees against them.  Some foreign workers pay to stay in Canada and get semi-skilled LMIA jobs to settle in the country. The TFWP has led to profiteering by unscrupulous employers and immigration consultants. Last year, the Federal Government changed regulations to ensure temporary foreign workers are not charged for their recruitment. Details of the immigration employment scam Ottawa is being urged to crack down on an immigration scam in which people looking for work in Canada are forced to pay tens of thousands of dollars to potential employers – as well as a charge to immigration experts – in order to obtain work. Last year, the federal Immigration Department updated procedures to try to prevent firms from charging people money to work in Canada through the Temporary Foreign Worker Program, which is designed to replace occupations where no Canadians or permanent residents are available. However, immigration experts claim that, despite Immigration, Refugees, and Citizenship Canada’s crackdown, some temporary foreign workers are still being exploited and forced to pay large sums to acquire a job in Canada. The Globe and Mail spoke with immigration consultants, attorneys, and immigrants who are concerned about a scam in which would-be immigrants pay a Canadian business to apply for a Labour Market Impact Assessment (LMIA), a document indicating the necessity for a temporary foreign worker. The worker can apply for a work permit after his or her company obtains the LMIA from Employment and Social Development Canada (ESDC). The Immigration Department informed The Globe and Mail that it was aware of LMIA fraud scams, but that it had taken efforts last year to protect against them through regulatory reforms. “Sectors identified as high risk for LMIA fraud receive an enhanced assessment to validate the employer’s business operations and the human resource needs,” the IRCC stated in a statement. What is a Labour Market Impact Assessment (LMIA)? Before hiring a foreign worker, a Canadian business may be required to get a Labour Market Impact Assessment (LMIA). A positive LMIA will demonstrate that a foreign worker is required to fill the position. Additionally, it will demonstrate that no Canadian citizen or permanent resident is qualified for the position. A confirmation letter is another name for a positive LMIA. LMIAs are used to fill a wide range of openings, including unskilled occupations in the catering, hotel, and retail industries, as well as semi-skilled and skilled positions. The worker can submit a work permit application after the employer receives the LMIA. On September 29, 2023, the Government of Canada implemented changes to the upfront medical examination requirement for Express Entry applicants. As of October 1, 2023, upfront medical examinations are no longer mandatory during the application process.  Instead, applicants are advised to await instructions before proceeding with a medical examination. Applicants must complete a medical examination within 30 days of receiving the instructions. On September 26, 2023, the Ontario Immigrant Nominee Program (OINP) conducted an invitation draw under the OINP Human Capital Priorities Stream. The OINP issued 1,696 targeted Notifications of Interest (NOIs) to candidates with work experience in healthcare occupations.  Invited candidates’ CRS Express Entry score was between 350 and 462 points. This year, the province has invited 14,091 candidates through twelve Express Entry Human Capital Priorities Stream draws. In 2023, Ontario issued 34,696 invitations under all streams of OINP.  Invited Healthcare Occupations Candidates who had a comprehensive ranking system (CRS) score of 350-462 and work experience in the following national occupational classification (NOC) codes were notified. In your Express Entry profile, you must list your work experience in one of the following NOCs as your major NOC: NOC 31102 – General practitioners and family physicians NOC 31300 – Nursing coordinators and supervisors NOC 31301 – Registered nurses and registered psychiatric nurses NOC 32101 – Licensed practical nurses NOC 33102 – Nurse aides, orderlies, and patient service associates About the OINP Human Capital Priorities Stream The Express Entry Human Capital Priorities immigration stream in Ontario is part of the Ontario Immigrant Nominee Program (OINP). It allows foreign workers with the necessary skilled work experience, language abilities, and education to apply to live and work permanently in Ontario. Before you can apply online to be nominated for permanent residence by the Ontario government, you must have a valid profile in the Immigration, Refugees, and Citizenship Canada’s (IRCC’s) Express Entry system and receive a Notification of Interest from Ontario. What are OINP Human Capital Priorities Stream Requirements? To be successful in the OINP Capital Priorities Stream you need to meet these requirements: You must choose which of the two federal programs you want to be assessed against: the Canadian Experience Class and the Federal Skilled Workers Program. You must hold a bachelor’s, master’s, or PhD from Canada or the equivalent in another nation. You must be able to understand, read, write, and speak English or French at a level 7 or higher on the Canadian Language Benchmark (CLB).
