Safe Third Country Agreement

Canada updated instructions for the Safe Third Country Agreement

On May 4, 2023, the Government of Canada published updated instructions for the Safe Third Country Agreement. Effective March 25, 2023, the Safe Third Country Agreement (STCA) has been extended to cover the entire land border through the implementation of the Additional Protocol (AP).  The AP, together with corresponding regulatory amendments, expands the application of the STCA to include individuals who submit an asylum claim when entering Canada between ports of entry, as well as those who submit a refugee claim inland following an irregular entry.  In order to take into account this expansion of the STCA, Updates have been made to the related program delivery instructions.   Protection claims processing in Canada: Safe Third Country Agreement (STCA) If the person seeking refuge came to Canada directly or indirectly from a nation listed in the regulations that are not their country of nationality or their previous country of residence, their refugee claim cannot be referred to the Refugee Protection Division.  The Safe Third Country Agreement also referred to as the STCA, is an agreement that Canada and the US participated in and went into effect on December 29, 2004.  Unless they can convince an officer that an exemption to the agreement applies, those who arrive in Canada from the US (or vice versa) and seek refugee protection are allowed to return to the US under the terms of the agreement. Immigration to Canada

Immigration to Canada has increased by 40% in 2023

According to the Immigration, Refugees and Citizenship Canada (IRCC) data, immigration to Canada increased by nearly 40% in the first two months of 2023 compared to the same period last year.  Canada admitted 100,430 new permanent residents in January and February 2023 – a dramatic increase from 72,815 permanent residents accepted in the first two months of 2022. This increase shows that if this trend continues throughout the rest of 2023, it will be a record year for immigration to Canada. If immigration at that rate continued for the rest of 2023, Canada would welcome 602,580 new permanent residents this year, significantly over Ottawa’s target of 465,000 new permanent residents. According to Ottawa’s 2023-2025 Immigration Levels Plan, 485,000 new permanent residents will come to Canada in 2024 and another 500,000 in 2025.    2023-2025 Immigration Levels Plan The recently released Immigration Levels Plan for 2023–2025 shows that the Canadian government is increasing its immigration goals once again. Canada aims to accept 500,000 new permanent residents in a single year by the year 2025.  According to the suggestion, presented by Minister of Immigration Sean Fraser on November 1, 2022, Canada hopes to accept 1.45 million new permanent residents over a period of three years, representing all immigration categories. Immigration Levels plans 2023-2025 are welcoming immigrants via immigration programs,    Economic programs include:  Federal High Skilled Federal Economic Public Policies Federal Business Caregivers Agri-Food Pilot Rural and Northern Immigration Pilot Economic Mobility Pathways Project Atlantic Immigration Program Provincial Nominee Program Quebec Skilled Workers and Business Total Economic Target: 266,210   Family Programs Immigration programs include:  Spouses, Partners, and Children Parents and Grandparents In Family Program Tarteg: 106,500   Refugees and Protected Persons Programs include:  Protected Persons in Canada and Dependents Abroad Resettled Refugees – Government-Assisted Resettled Refugees – Privately Sponsored Resettled Refugees – Blended Visa Office-Referred Total Refugees and Protected Persons Target: 76,305 Total Humanitarian & Compassionate and Other Target: 15,985   The targets for principal applicants, spouses, and dependents who land through Express Entry will increase to 82,880 in 2023, 109,020 in 2024, and 114,000 in 2025.
